1 Introduction

These are Callioza’s Terms of Use

In these terms and conditions, the following definitions apply: Callioza: The Company / Supplier
Buyer: the natural person who is not acting in the exercise of a profession or business and who enters into a distance contract with Callioza.

2. Applicability

The Buyer (customer) accepts these terms and conditions when placing an order. These general terms and conditions apply to Callioza’s offer and to any distance agreement concluded between Callioza and the Buyer. Callioza expressly excludes the applicability of (delivery) conditions of the Buyer, unless expressly agreed otherwise in writing.

3. Agreement

The agreement is concluded at the time of acceptance by the Buyer of the offer and the fulfillment of the associated conditions. The order is put into production after the supplier has received payment of the agreed price. All orders are subject to our Terms and Conditions. The order will be confirmed immediately by e-mail. After the order has been put into production, cancellation of the order is no longer possible. We will confirm your order immediately by email.

4. Delivery times

The estimated delivery times communicated by e-mail are representative of the average delivery times. The place of delivery is the address that the Buyer has made known to Callioza. Both can under no circumstances be the reason for compensation, annulment of an order or any other form of compensation.

5. Payment

The Buyer places the order by making a payment in our order process. Upon receipt of your payment, your order will be placed and the agreement will be drawn up. After we have received your payment, we will send you a confirmation email. Prices on the website, emails and in promotional materials are for informational purposes only and may vary from time to time. All prices on the website include sales tax (VAT)

6. No right of withdrawal

The right of withdrawal does not apply to our products as they are made to the buyer’s specifications or are clearly personalized and cannot be returned due to their nature.

7. Warranty

Callioza does not guarantee that the delivered product is resistant to the effect of UV radiation and other environmental factors. If the product shows a material or manufacturing defect, the Buyer is entitled to repair or replacement of the product free of charge. The Buyer is only entitled to a replacement if repair of the product is not possible. No warranty applies to damage caused by incorrect use or application of the delivered products. The proof of purchase (order confirmation after payment) serves as proof of warranty. If repair or replacement is impossible, Callioza has the right to dissolve the agreement and to credit the Buyer in full.
The Buyer is aware that Callioza sells reproductions and that these are a copy of the original painting. Deviations between the delivered and the original painting cannot constitute a reason for rejection, discount, dissolution of the agreement or compensation.
The quality of our photo prints is dependent on the quality of the supplied image material that we receive from the Buyer and therefore we cannot accept claims based on differences in colors between a print and the original digital image. If you are dissatisfied with your order or our service, we request that you notify us within 14 days of receiving your order so that we can offer you a suitable solution.

8. Intellectual Property Rights

The Buyer guarantees that he/she has all copyright and other rights regarding the supplied image material. Callioza can never be held accountable or liable in any way. Files supplied by the Buyer are only used for the agreed assignment between Callioza and the Buyer. Callioza does not do anything with the image files supplied by customers outside the order, without written permission from the customer. Neither in print, nor digitally and/or in publication and/or parts of the file in any other way.

9. Liability

Callioza is not liable for damage of any nature whatsoever and which arises because Callioza relies on incorrect information provided by the Buyer or because the products are used improperly after delivery and which arise due to the use of the product by the Buyer. If Callioza is liable for damage suffered by the Buyer as a result of a failure in the execution of this agreement, Callioza’s liability will be limited to a maximum of the amount of the purchase price.

10. Privacy

The personal data that Callioza collects is used exclusively for the conduct of Callioza’s business operations. Personal data will not be provided to third parties. Data will only be provided to third parties in the following cases: if required by law.

11. Applicable law

The legal relationship between Callioza and Buyer is governed solely by Dutch law. All possible disputes will be submitted exclusively to the competent judge of the Court.
